This outline provides information on how to represent a client whose claim for benefits under his or her health insurance plan has been denied. Although the state law information focuses on New York, the outline primarily discusses federal law. The outline includes sections on identifying the governing law, determining the role of ERISA, and identifying and understanding relevant fact and legal issues that are likely to arise. It also includes useful case citations, and provides guidance on gathering information for a claim, preparing an ERISA request for review, and litigating a case.
